Emergent Technologies, LLC Terms & Conditions
Effective date: October 1, 2026
Contact: info@emergentsolutions.tech
These Terms & Conditions (“Terms”) govern your use of websites, applications, and related messaging services provided by Emergent Technologies, LLC (“Emergent Technologies,” “we,” “us,” or “our”) that link to or identify these Terms. The application-use provisions also serve as our Acceptable Use & User Agreement.
1. Scope and Acceptance
Our services support authorized operational, training, administrative, and public-safety activities. Public website information is available without an application account; restricted applications require authorization.
By affirmatively accepting these Terms, creating an account where these Terms are presented, or using services after receiving notice that these Terms apply, you agree to them. If you do not agree, do not use the covered services. If you act on behalf of an organization, you must have authority to do so.
A separate signed service agreement may govern an organization's use of our services. If that agreement conflicts with these Terms, the signed agreement controls for the services it covers, subject to applicable law. Acceptance of these Terms does not by itself constitute consent to receive text messages.
2. Accounts and Authorized Access
Restricted services are available only to users authorized by us or the organization administering the application. You must provide accurate account information, protect your credentials, and use only the access permissions assigned to you.
Do not share accounts, transfer credentials, access another person's account without authorization, bypass security controls, or access information outside your authorized role. Notify us promptly of suspected account compromise at info@emergentsolutions.tech.
3. Acceptable Use
You may use our services only for their intended, authorized purposes and in compliance with applicable law and applicable organizational policies. You must not:
- Introduce malware, disrupt services, or interfere with other users.
- Attempt unauthorized access or conduct security testing without permission.
- Knowingly submit fraudulent or misleading operational records.
- Harass others, distribute unlawful content, or infringe intellectual property or privacy rights.
- Bypass authentication, access restrictions, or audit controls.
- Collect, export, or disclose information without appropriate authorization.
- Use our services to send unsolicited or otherwise unauthorized communications.
4. Confidential Information and User Content
You are responsible for ensuring that you have the authority to enter, access, use, and disclose information through the services. Use approved channels when copying, exporting, printing, or transmitting confidential information, and follow the legal and contractual requirements applicable to that information.
Do not submit regulated or specially restricted information unless the relevant service and agreements expressly support that use. These Terms do not themselves establish compliance with a particular security standard or authorize processing of any specific category of regulated data.
You or your organization retain the rights you hold in content submitted to the services. You authorize us to process that content only as reasonably needed to provide, maintain, secure, and support the services, comply with applicable law, and carry out applicable agreements and our Privacy Policy.
5. Privacy and Administrative Monitoring
Our Privacy Policy explains how we handle personal information, including mobile numbers and messaging consent records.
Authorized administrators may review service activity and records for legitimate operational, support, security, and compliance purposes, subject to applicable law and the Privacy Policy. Administrative access does not eliminate your statutory privacy rights or authorize unrestricted disclosure of personal information.
6. SMS and Mobile Messaging Terms
Program. Emergent Technologies Verification & Operational Alerts provides verification codes and opt-in operational alerts relating only to scheduling and contracts. Contract team members who opt in may receive contract-status alerts triggered by a team leader or supervisor to notify that team. The specific notification categories are identified when you enroll. These messages are not advertising or promotional messages. Being assigned to a team or contract does not, by itself, enroll you in text alerts.
Consent. Enrollment requires your affirmative consent through the opt-in method presented for the program. Providing a mobile number or accepting general application terms alone does not enroll you in recurring messages. Consent to text messages is not a condition of purchase. Messages may be sent using automated technology. You must be the subscriber or authorized user of the number you provide.
Frequency. Verification codes are sent in response to your verification requests. Operational alerts are event-driven and depend on the scheduling and contract notifications you opt into, including contract-status alerts initiated by a team leader or supervisor. There is no fixed daily or weekly sending schedule. The applicable message frequency or maximum count is disclosed when you enroll, and messages will remain within that disclosed scope.
Charges. Message and data rates may apply. Your wireless provider determines any charges under your plan.
Opt-out. Reply STOP to stop messages from the program. We may send one confirmation of your opt-out, after which program messages will stop unless you enroll again. You may also request an opt-out by emailing info@emergentsolutions.tech. Opting out of text messages does not automatically close your application account.
Help. Reply HELP for assistance, or contact info@emergentsolutions.tech.
Number changes. Notify us or update your account before discontinuing or transferring a registered number. Do not enroll a number that you are not authorized to use.
Delivery. Message delivery depends on wireless networks and other service providers and is not guaranteed. Carriers are not liable for delayed or undelivered messages, to the extent permitted by law.
Mobile privacy. We do not sell or rent mobile numbers or disclose mobile numbers or messaging consent records for another party's advertising or promotions. Limited processing needed to operate messaging services and disclosures required by law are described in our Privacy Policy.
7. Not an Emergency Communications Service
Our website, support email, and text messaging program are not emergency reporting channels and are not substitutes for emergency services or an organization's required response procedures. Do not rely on a text message as the sole means of delivering time-critical information. In an emergency, use the appropriate emergency number or your organization's designated emergency channel.
8. Availability and Warranties
Unless a separate written agreement provides otherwise, services are supplied on an “as is” and “as available” basis. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not guarantee uninterrupted operation, error-free results, or delivery of every notification.
Outages, maintenance, and errors may occur. Users remain responsible for reviewing outputs and following required procedures, including use of an official system of record where applicable. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.
9. Limitation of Liability
To the extent permitted by applicable law and subject to any controlling written service agreement, Emergent Technologies, LLC is not liable for indirect, incidental, special, or consequential damages arising from use of or inability to use the services, including resulting loss of profits or data.
This limitation does not apply to gross negligence, willful misconduct, or liability that cannot lawfully be limited. These Terms do not waive nonwaivable consumer or other statutory rights.
10. Intellectual Property
Our software, source code, branding, designs, and other proprietary materials belong to Emergent Technologies, LLC or their respective licensors. Subject to these Terms and applicable agreements, you receive a limited, nonexclusive, nontransferable right to use the services for authorized purposes. No ownership of our software or branding transfers to you. Third-party materials remain subject to their applicable licenses.
11. Suspension and Termination
Subject to applicable law and service agreements, we or the authorized organization administrator may restrict or end access when authorization ends, a role changes, these Terms are violated, or action is reasonably necessary to protect the services or other users. We will provide notice when reasonably practicable, but urgent security or legal circumstances may require immediate action.
Upon termination, you must stop using restricted services. Retention and deletion of records are governed by the Privacy Policy, applicable agreements, and law. Provisions intended by their nature to survive termination remain applicable.
12. Changes to These Terms
We may update these Terms to reflect changes to services or applicable requirements. Revised Terms will identify their effective date, and material changes will be communicated as appropriate. We will request renewed acceptance when required. Updates do not automatically expand SMS consent or enroll you in additional messaging programs.
13. Other Rights and Agreements
These Terms do not change your employment relationship or replace applicable organizational policies or agreements. If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law. Our failure to enforce a provision on one occasion does not waive our right to enforce it later.
